Welcome to UnclePharmacy (the “Site”). These Terms & Conditions (“Terms”) govern your access to and use of the Site, your purchase of products, and related services offered by UnclePharmacy (“we,” “us,” “our”). By using the Site, placing orders, or accessing products or services, you agree to these Terms. If you do not agree, do not use the Site.
1. Eligibility & User Representations

You represent and warrant that you are at least 18 years of age and are legally able to enter into and perform binding contracts in the United States.

You will use the Site and its offerings in compliance with all applicable federal, state, and local laws and regulations, including laws governing the prescribing, dispensing, and delivery of prescription drugs, controlled substances, and telemedicine.

You agree not to use the Site in any manner that could harm, disable, overburden, or impair any server, or interfere with any other party’s use and enjoyment of the Site.
2. Medical / Health Disclaimer

The information on this Site (including product descriptions, articles, dosage guidance, etc.) is for general informational purposes only and does not constitute medical advice.

You should consult with a licensed healthcare provider (physician, pharmacist, etc.) before starting, changing, or stopping any medication or treatment.

We do not guarantee that any product is suitable, safe, or effective for your particular condition or needs.

If you believe you have a medical emergency, please contact your physician or emergency services immediately.
3. Prescription Requirements & Telemedicine

Many products offered require a valid prescription from a licensed U.S. healthcare provider. You agree to provide such prescriptions when required.

We may use telemedicine services or third-party clinical review to evaluate prescription requests. Any prescription is subject to review, approval, and at our discretion, denial in compliance with applicable medical and legal standards.

Controlled substances, if offered, will only be dispensed in full compliance with the federal Controlled Substances Act, DEA regulations, and relevant state laws.

We may refuse to fill any prescription or order that we determine (in our sole discretion) to be medically inappropriate, unverified, or otherwise noncompliant.
4. Licensing & Legal Compliance

We will maintain all required federal and state pharmacy licenses, including non-resident pharmacy licenses in states where we ship prescription medications.

If we dispense controlled substances, we will comply with DEA registration, reporting, and disclosure requirements (e.g., website disclosures, notifications).

We will post on our homepage (or a clearly linked page) the disclosure required by law, including the name and address of the pharmacy (as per its DEA registration), contact information, pharmacist-in-charge, states of licensure, and certification of compliance.
5. Product Information & Pricing

We aim to present accurate product descriptions, available quantities, ingredients, dosage forms, and prices. However, we do not warrant that such descriptions or pricing are error-free.

Prices, availability, and offers may change without notice. The price applicable is the one in effect at the time your order is placed (unless we notify you otherwise).

We reserve the right to limit quantities, refuse or cancel orders (even after acceptance) if errors or discrepancies are found.
6. Orders, Payment & Shipping

To place an order, you must provide complete, accurate, and up-to-date personal, billing, and shipping information.

You authorize us to charge your selected payment method (credit card, debit card, electronic payment, etc.) for the order total, including applicable taxes, shipping, and handling.

We will ship to U.S. addresses only, unless otherwise stated. Shipping times are estimates; we do not guarantee delivery dates.

Risk of loss and title to products pass to you upon transfer to the carrier.

You are responsible for any customs, duties, or import taxes for any cross-border shipments (if allowed). (If you intend to ship internationally, ensure compliance with destination country’s laws.)
7. Cancellation, Returns & Refunds

You may cancel an order before it ships. Once the order has shipped, cancellation is not guaranteed.

Due to the nature of prescription and health products, we generally do not accept returns unless the product is defective, damaged, or incorrectly shipped.

If you receive a defective, damaged, or wrong product, contact us promptly. We may require photographic evidence or return of the item.

If the return is approved, we may offer a replacement, store credit, or refund (at our discretion). Refunds will be made to the original payment method within a reasonable timeframe.
8. Intellectual Property

All content, trademarks, logos, designs, graphics, software, and text on the Site are our property or licensed to us, unless otherwise stated.

You may view, download, or print content solely for personal, noncommercial use, provided you retain all copyright or proprietary notices.

9. User Submissions & Reviews

By submitting reviews, comments, or other content (“User Content”), you grant us a nonexclusive, royalty-free, worldwide, perpetual license to use, reproduce, modify, adapt, publish, and distribute such content in any media.

You represent and warrant that your User Content is lawful, does not infringe any third-party rights, and is not defamatory, obscene, or otherwise objectionable.

We reserve the right to remove or refuse any User Content at our discretion.
10. Disclaimers & Limitation of Liability

The Site, services, and products are provided “as is” and “as available,” without warranties of any kind, express or implied (including warranties of merchantability, fitness for a particular purpose, or noninfringement).

We do not guarantee uninterrupted or error-free access to the Site or services.

To the maximum extent permitted by law, our liability to you for any claim relating to your use of the Site, products, or services (including negligence or breach of contract) is limited to the amount you paid for the relevant product(s).

In no event shall we (or our affiliates, officers, employees, or agents) be liable for indirect, incidental, special, punitive, or consequential damages (including loss of profits, data, or business interruption), even if we were advised of the possibility of such damages.
11. Indemnification
You agree to defend, indemnify, and hold harmless UnclePharmacy, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to:

Your use of or inability to use the Site or services;

Your violation of these Terms;

Your violation of any laws or third-party rights;

Your User Content or representations;

Any claim that your actions caused damage to a third party.
12. Changes to the Terms
We may modify these Terms at any time in our discretion. We will post the updated version with a new “Last Updated” date. Your continued use of the Site after modifications means you accept the revised Terms (unless prohibited by law).
If we change the dispute resolution, class action waiver, or arbitration provisions, those changes will not apply retroactively to disputes for which you have already filed notice or had actual knowledge.
13. Governing Law, Dispute Resolution & Arbitration

If any provision of these Terms is held invalid or unenforceable under applicable law, it will be modified or severed to the minimum extent necessary, and the remaining provisions will stay in full effect.

Failure to enforce any right or provision under these Terms does not constitute a waiver of that right or provision in the future.
15. Entire Agreement
These Terms, along with our Privacy Policy and any other policies referenced herein (e.g. Prescription Policy, Shipping Policy), constitute the entire agreement between you and us regarding your use of the Site and services, superseding all prior or contemporaneous agreements, whether oral or written.
